1. Introduction
Welcome to Vynt, operated by Vynt Technology OÜ (16945271) ("we," "our," "us").
These Terms of Service ("Terms") govern your access to and use of our platform and services.
By accessing or using Vynt (Apple ID: 6560116262; Android Bundle Id: com.vynttech.vynter, Web: https://vynt.eu/), you agree to comply with these Terms.
If you do not agree, you may not use our services.
2. User Responsibilities
1. Posting Job Requests
Clients using Vynt may post job requests for physical tasks.
Clients are responsible for ensuring that job descriptions are accurate, lawful, and clearly defined.
Clients must not post misleading, fraudulent, or inappropriate job listings.
2. Compliance with Laws and Regulations
Clients must ensure that their job postings and engagements comply with all applicable laws and regulations.
Any illegal, unsafe, or unlicensed activities are strictly prohibited.
Clients are solely responsible for ensuring that any workers hired meet legal and professional requirements for the task.
3. User Conduct
Users must engage respectfully and professionally with other users.
Clients shall not discriminate against or harass workers based on race, gender, religion, or any other protected category.
Users must not attempt to circumvent the platform's intended use for personal gain.
3. Account Registration and Security
1. Accurate Information
Users must provide truthful and up-to-date registration details.
Any attempt to create false or duplicate accounts may result in suspension or termination.
2. Account Security
Users are responsible for safeguarding their login credentials.
Unauthorized access to another user's account is strictly prohibited.
3. Account Suspension
We reserve the right to suspend or terminate accounts involved in fraudulent, abusive, or illegal activities.
4. Age Requirement
You must be at least 18 years old to use Vynt.
We collect your date of birth during registration to verify that you meet this age requirement.
4. Platform as a Connection Service
1. Facilitation Role
Vynt serves solely as a matching platform to connect clients with workers
Vynt does not process payments, guarantee service quality, or mediate disputes.
2. Financial Responsibility
Payments for services are managed directly between clients and workers.
Vynt does not process payments, guarantee service quality, or mediate disputes.
Users are solely responsible for financial transactions and ensuring payments are fulfilled.
3. Tax Obligations
Vynt is not responsible for taxes owed by users on their earnings.
Users must comply with local tax regulations regarding payments and earnings.
5. Prohibited Activities
1. Illegal or Inappropriate Job Listings
Users are strictly prohibited from posting jobs related to any illegal activities, such as drug trafficking, money laundering, prostitution, etc.
2. Fraudulent or Misleading Behavior
Users must not provide false information or impersonate another person.
Misleading job descriptions or attempts to exploit workers will result in removal from the platform.
3. Misuse of the Platform
Users must not use Vynt for any unlawful, harmful, or unethical purposes.
Any attempt to manipulate ratings, reviews, or job postings will be subject to suspension.
Any attempt to manipulate job statuses or completed work to avoid paying service fees is strictly prohibited.
Any form of rating manipulation, including but not limited to fake reviews, artificially boosting one's own rating, or deliberately lowering another user's rating, is strictly prohibited.
6. Counter-Terrorism Content Policy (TCO)
1. Prohibited Content
In accordance with Regulation (EU) 2021/784 of the European Parliament and of the Council on addressing the dissemination of terrorist content online, when using our services, it is prohibited to disseminate terrorist content that, for example, incites or glorifies the commission of terrorist offences, recruits for terrorist groups, or provides instructions for the manufacturing or use of explosives, firearms or other weapons, or toxic or dangerous substances, as well as other specific methods or techniques for committing a terrorist offence referred to in points (a) to (i) of Article 3(1) of Directive (EU) 2017/541, or contributing to its commission.
2. Our Measures
Terrorist content identified by us is removed immediately.
We respond to removal orders from competent authorities within one (1) hour.
In reviewing and removing content, we apply the principles of due diligence and proportionality.
Our primary measures for content review and moderation are: all services are manually reviewed before publication, and moderators can remove content at any time.
3. Automated Tools
We do not currently use automated tools for the detection of terrorist content. All content moderation is carried out manually by our staff.
4. Contextual Considerations in Special Cases
For content created for educational, artistic, scientific, or journalistic purposes, we always evaluate the purpose and context of dissemination.
5. Notification
After content removal, we notify the user/content provider, unless the competent authority has prohibited notification for reasons of public security.
6. Retention of Removed Content
Removed content and associated data are securely stored for six (6) months.
User-generated content is also preserved on our servers.
Upon request from a competent authority or court, terrorist content is retained for an additional specified period.
7. Complaint Resolution Mechanism (TCO)
1. Filing a Complaint
In accordance with Regulation (EU) 2021/784, if your content has been removed, you have the right to file a complaint.
Submit your complaint via email to info@vynt.eu, including information about the removed content and a justification for why the removal or blocking decision should be reversed.
2. Review and Decision
We will review the complaint and notify you of the results within two weeks of receipt.
If the complaint is upheld, the content will be restored immediately.
If the complaint is rejected, we will provide clear reasons for the decision.
3. Legal Remedies
Our decision does not limit your right to seek judicial protection of your rights.
8. TCO Contact Point
1. Electronic Contact Point
Our electronic contact point (info@vynt.eu) is established in accordance with Regulation (EU) 2021/784.
The contact point enables competent authorities to submit removal orders and ensures their prompt processing within one (1) hour.
2. Communication Languages
The following languages may be used for submitting removal orders and subsequent communication: Estonian and English.
9. Privacy and Data Protection
1. Data Collection
We collect and process user data as outlined in our Privacy Policy.
Personal information will only be used in accordance with privacy laws.
2. Data Security
We take reasonable security measures to protect user data but cannot guarantee complete security against cyber threats.
3. User Rights
Users may request data deletion or modification by contacting us.
10. Messages from Specialists
1. Service Messages
When booking through the Vynt platform, the User may receive messages from the selected Specialist necessary for the fulfillment of the booking, including appointment confirmations, reminders, changes, or cancellations of services.
Such messages are service messages and may be sent regardless of the User's marketing preferences.
2. Marketing Messages
The User acknowledges and agrees that the Specialist may send them informational and marketing messages (including SMS and emails) regarding the services, promotions, and special offers of that Specialist.
Marketing messages may be sent exclusively in relation to the services of the Specialist with whom the User has previously made a booking through the Vynt platform.
3. Opting Out of Messages
The User has the right to opt out of receiving marketing messages at any time by following the instructions provided in the relevant message or by other available means.
Opting out of marketing messages does not affect the receipt of service notifications necessary for the fulfillment of the booking.
4. Liability
Vynt provides solely the technical capability for message transmission between Users and Specialists and is not responsible for the content of marketing messages sent by Specialists.
In case of detection of violations of these Terms or applicable laws, Vynt has the right to limit or terminate the use of the messaging functionality.
11. Liability and Disclaimers
1. Service Limitations
Vynt provides a platform for users to connect but does not assume responsibility for job quality, payment completion, or disputes.
Vynt is not responsible for the quality of work performed by workers.
2. Assumption of Risk
Users acknowledge that they assume all risks associated with job postings and engagements.
Vynt is not liable for damages, losses, or injuries resulting from user interactions.
3. Third-Party Disputes
Since Vynt does not manage payments or job outcomes, any disputes must be resolved directly between clients and workers.
Users may report violations of these Terms, but Vynt is not obligated to intervene in individual disputes.
12. Termination and Account Suspension
1. User-Initiated Termination
Users may terminate their accounts at any time through account settings.
2. Platform-Initiated Termination
We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.
3. Effects of Termination
Upon termination, users lose access to their accounts and all associated platform benefits.
13. Changes to the Terms
1. Policy Updates
We may update these Terms periodically.
Users will be notified of significant changes.
2. Continued Use
Continued use of Vynt after updates indicates acceptance of the revised Terms.
