Terms and Conditions for Vynt Pro

1. Introduction

Welcome to Vynt Pro, operated by Vynt Technology OÜ (16945271) ("we," "our," "us").

These Terms of Service ("Terms") govern your access to and use of our platform and services.

By accessing or using Vynt Pro (Apple ID: 6590626487; Android Bundle Id: com.vynttech.vyntpro, Web: https://vynt.eu/pro), you agree to comply with these Terms.

If you do not agree, you may not use our services.


2. User Responsibilities

1. Applying for Job Requests

Workers using Vynt Pro may browse and apply for job requests posted by clients.

Workers must ensure they have the necessary skills, qualifications, and legal rights to perform the requested tasks.

Workers must complete all accepted jobs in a professional and timely manner.

2. Compliance with Laws and Regulations

Workers must comply with all applicable local, state, and national labor laws and regulations.

Workers are solely responsible for ensuring they have the proper certifications or licenses required for specific job types.

Any engagement in illegal, unsafe, or unlicensed activities is strictly prohibited.

3. Tax Obligations

Workers are fully responsible for declaring and paying taxes on their earnings.

Vynt Pro does not act as an employer and does not withhold taxes, insurance, or social security contributions on behalf of workers.

Workers must comply with all tax regulations in their respective jurisdictions.


3. Account Registration and Security

1. Accurate Information

Users must provide truthful and up-to-date registration details.

Any attempt to create false or duplicate accounts may result in suspension or termination.

2. Account Security

Users are responsible for safeguarding their login credentials.

Unauthorized access to another user's account is strictly prohibited.

3. Account Suspension

We reserve the right to suspend or terminate accounts involved in fraudulent, abusive, or illegal activities.

4. Age Requirement

You must be at least 18 years old to use Vynt Pro.

We collect your date of birth during registration to verify that you meet this age requirement.


4. Platform as a Connection Service

1. Facilitation Role

Vynt Pro serves solely as a matching platform to connect clients with workers

Vynt Pro does not process payments, guarantee service quality, or mediate disputes.

2. Financial Responsibility

Payments for services are managed directly between clients and workers.

Users are solely responsible for financial transactions and ensuring payments are fulfilled.


5. Prohibited Activities

1. Illegal or Inappropriate Job Listings

Users are strictly prohibited from posting jobs related to any illegal activities, such as drug trafficking, money laundering, prostitution, etc.

2. Fraudulent or Misleading Behavior

Users must not provide false information or impersonate another person.

Misleading job descriptions or attempts to exploit workers will result in removal from the platform.

3. Misuse of the Platform

Users must not use Vynt Pro for any unlawful, harmful, or unethical purposes.

Any attempt to manipulate ratings, reviews, or job postings will be subject to suspension.

Any attempt to manipulate job statuses or completed work to avoid paying service fees is strictly prohibited.

Users are strictly forbidden from attempting to redirect other users away from Vynt Pro to avoid platform service fees.

Any form of rating manipulation, including but not limited to fake reviews, artificially boosting one's own rating, or deliberately lowering another user's rating, is strictly prohibited.


6. Counter-Terrorism Content Policy (TCO)

1. Prohibited Content

In accordance with Regulation (EU) 2021/784 of the European Parliament and of the Council on addressing the dissemination of terrorist content online, when using our services, it is prohibited to disseminate terrorist content that, for example, incites or glorifies the commission of terrorist offences, recruits for terrorist groups, or provides instructions for the manufacturing or use of explosives, firearms or other weapons, or toxic or dangerous substances, as well as other specific methods or techniques for committing a terrorist offence referred to in points (a) to (i) of Article 3(1) of Directive (EU) 2017/541, or contributing to its commission.

2. Our Measures

Terrorist content identified by us is removed immediately.

We respond to removal orders from competent authorities within one (1) hour.

In reviewing and removing content, we apply the principles of due diligence and proportionality.

Our primary measures for content review and moderation are: all services are manually reviewed before publication, and moderators can remove content at any time.

3. Automated Tools

We do not currently use automated tools for the detection of terrorist content. All content moderation is carried out manually by our staff.

4. Contextual Considerations in Special Cases

For content created for educational, artistic, scientific, or journalistic purposes, we always evaluate the purpose and context of dissemination.

5. Notification

After content removal, we notify the user/content provider, unless the competent authority has prohibited notification for reasons of public security.

6. Retention of Removed Content

Removed content and associated data are securely stored for six (6) months.

User-generated content is also preserved on our servers.

Upon request from a competent authority or court, terrorist content is retained for an additional specified period.


7. Complaint Resolution Mechanism (TCO)

1. Filing a Complaint

In accordance with Regulation (EU) 2021/784, if your content has been removed, you have the right to file a complaint.

Submit your complaint via email to info@vynt.eu, including information about the removed content and a justification for why the removal or blocking decision should be reversed.

2. Review and Decision

We will review the complaint and notify you of the results within two weeks of receipt.

If the complaint is upheld, the content will be restored immediately.

If the complaint is rejected, we will provide clear reasons for the decision.

3. Legal Remedies

Our decision does not limit your right to seek judicial protection of your rights.


8. TCO Contact Point

1. Electronic Contact Point

Our electronic contact point (info@vynt.eu) is established in accordance with Regulation (EU) 2021/784.

The contact point enables competent authorities to submit removal orders and ensures their prompt processing within one (1) hour.

2. Communication Languages

The following languages may be used for submitting removal orders and subsequent communication: Estonian and English.


9. Privacy and Data Protection

1. Data Collection

We collect and process user data as outlined in our Privacy Policy.

Personal information will only be used in accordance with privacy laws.

2. Data Security

We take reasonable security measures to protect user data but cannot guarantee complete security against cyber threats.

3. User Rights

Users may request data deletion or modification by contacting us.


10. Newsletters and Marketing Campaigns

1. Newsletter Functionality

Vynt Pro may provide Specialists with functionality to send SMS and emails to their clients for the purpose of informing them about services, special offers, promotions, coupons, and other marketing campaigns.

Use of this functionality is an additional feature of the platform and may be provided on a paid or limited basis.

2. Permitted Recipients

The Specialist is entitled to send marketing messages exclusively to clients who have previously booked services from that Specialist through the Vynt platform.

Marketing messages may relate only to the Specialist's own services. Use of client contact data for other purposes is prohibited.

3. Prohibited Practices

The Specialist is prohibited from using external, purchased, rented, or otherwise obtained contact databases.

Adding recipients who have not booked with the Specialist through the Vynt platform is prohibited.

Bypassing unsubscribe mechanisms, masking the sender, or sending misleading messages is prohibited.

4. Unsubscribing and Compliance

Each marketing message must contain a simple, clear, and accessible way to opt out of further mailings.

The Specialist is obliged to respect the client's refusal to receive marketing messages and not attempt to resend after refusal.

5. Liability

The Specialist bears full responsibility for the legality of mailings, the content of messages, and compliance with data protection and electronic communications legislation.

Vynt provides solely a technical tool for sending messages and is not responsible for the content and legal grounds of the Specialist's marketing messages.

6. Measures in Case of Violations

In case of receiving complaints from clients, detection of violations of these Terms or applicable laws, Vynt has the right without prior notice to:

- temporarily or completely restrict the Specialist's access to the newsletter functionality;

- suspend or delete the Specialist's account;

- remove sent materials and campaigns.


11. Vynt Concierge (AI-Assisted Messaging)

1. Feature Overview

Vynt Concierge is an optional feature that lets professionals and companies automate replies to incoming customer direct messages (DMs) on connected messaging channels, including Instagram and Facebook Messenger.

When the feature is enabled, incoming customer messages are processed by an artificial intelligence (AI) language model to generate automated replies on your behalf.

Vynt Concierge works only on messaging channels that you have connected and expressly enabled. You can turn the feature on or off at any time in your account settings.

2. Your Responsibilities

You are responsible for reviewing the configuration of Vynt Concierge, including booking-only mode and first-reply delay settings.

Customers who message your connected channels are not necessarily Vynt users and may not have accepted Vynt's Terms of Service or Privacy Policy. You are responsible for informing your customers that an AI system may respond to their messages.

You acknowledge that using Vynt Concierge on your channels is your decision. You are solely responsible for ensuring that your use of AI-assisted messaging complies with all applicable laws and regulations in your jurisdiction, including data protection and consumer protection requirements.

3. AI-Generated Content

Responses generated by Vynt Concierge are produced by a third-party AI language model using your service information, business details, and conversation context.

Vynt does not guarantee that AI-generated replies will be accurate, complete, appropriate, or up to date. The AI may produce incorrect information, including wrong prices, unavailable time slots, or factually inaccurate statements.

You should regularly review conversations handled by Vynt Concierge. You may intervene at any time by replying directly in the conversation, which pauses the AI for that conversation, or by using the available commands to enable or disable the AI.

4. Data Processing

When Vynt Concierge is active, incoming customer message content and conversation context are sent to a third-party AI service provider to generate replies. This processing is described in our Privacy Policy.

Message content is processed in real time. Vynt retains conversation data in accordance with the retention periods described in our Privacy Policy.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Vynt is not liable for any damages, losses, or claims arising from the content of AI-generated replies, including but not limited to incorrect information provided to customers, missed business opportunities, reputational harm, or customer complaints.

Vynt provides Vynt Concierge as a technical tool. The professional or company that enables the feature is responsible for the outcomes of its use.


12. Liability and Disclaimers

1. Service Limitations

Vynt Pro provides a platform for users to connect. Vynt Pro does not assume responsibility for service quality, completed payments, or dispute resolution.

Vynt Pro is not responsible for the quality of services provided by professionals.

2. Assumption of Risk

Users acknowledge and accept the risks associated with posting tasks, booking services, and interacting with other users.

Vynt Pro is not liable for damages, losses, or injuries resulting from user interactions.

3. Third-Party Disputes

Because Vynt Pro does not manage payments or service outcomes, any disputes must be resolved directly between clients and professionals.

Users may report violations of these Terms, but Vynt Pro is not required to intervene in individual disputes.


13. Termination and Account Suspension

1. User-Initiated Termination

Users may terminate their accounts at any time through account settings.

Users will be notified of significant changes.

2. Platform-Initiated Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

3. Effects of Termination

After termination, users lose access to their account and all related platform features.


14. Changes to These Terms

1. Updates to These Terms

We may update these Terms from time to time.

Users will be notified of significant changes.

2. Continued Use

Your continued use of Vynt Pro after an update means that you accept the revised Terms.
